This is the official privacy policy ("Privacy Policy") for URGETM, the proprietary branded online digital music service and the Website provided by MTVN DMS Inc., a subsidiary of Viacom International Inc. ("MTVN" "we", "our" or "us"). This Privacy Policy is a part of your Agreement with us which also includes the Terms of Use Agreement, the which can be read at http://www.urge.com/termsofuse.jhtml the Copyright Compliance Policy which can be read at http://www.urge.com/copyrightcompliancepolicy.jhtml the EULA that relates to the Software we make available for your use in connection with URGE, whether or not you are an URGE Registered User and which can be read at http://www.urge.com/EULA.jhtml, and, if you are a Registered User, the Registered User Agreement for URGE (which can be read at http://www.urge.com/termsofuse.jhtml#registeredUser). Any terms that are not defined in this Privacy Policy have the meaning set forth in those documents. We may collectively refer to this Privacy Policy, together with the Terms of Use Agreement, the Copyright Compliance Policy, Registered User Agreement and EULA as the "Agreement". This Privacy Policy is a part of the terms and conditions of the Terms of Use Agreement and is legally binding on all users.
This Privacy Policy governs only the personally identifiable information collected by the Website, the Software and the Service, including, without limitation, information relating to our ability to manage the digital rights associated with Content available in connection with our Website and URGE ("Personal Information") and does not cover any other information, whether collected in any other manner or for any other purpose, nor any other web site or service of any MTV Networks' programming channel or service of MTVN, its Parent Company, any of the MTVN Entities or any other company, unless specifically stated.
Overview: Our Privacy Policy is intended to explain our privacy practices and inform you as to:
- The kind of Personal Information we collect from users and how such Personal Information is collected;
- How we use Personal Information;
- The circumstances under which we disclose Personal Information to third parties;
- How you can access, update or delete any Personal Information we collect about you; and
- The mechanisms we have implemented to protect your Personal Information.
The Website, the Software and the Service are offered and made available only to users 13 years of age or older who reside in the Territory (as defined in the Terms of Use Agreement). If you are not yet 13 years old or do not reside in the Territory, please discontinue using the Website, the Service and any Software immediately, or if, for any reason, you do not agree with this Privacy Policy, please do not participate in the activities, services features or functions that require you to provide your Personal Information.
We reserve the right to revise this Privacy Policy at any time and from time to time by posting an updated and revised version on the Website and/or in the Service, without advance notice to you. The revisions shall be effective to you immediately upon posting. We encourage you to check this Privacy Policy, the Terms of Use Agreement, the Copyright Compliance Policy , the EULA and, if applicable to you, the Registered User Agreement often for updates so you are aware of the most current terms and conditions of the Agreement that apply to you. We may also, at our discretion, email you about these changes.
We are committed to protecting our users' privacy. Keeping Personal Information you share with us secure, whether on the Website, through the use of Software or the Service, including Personal Information in any of the Registered User Information you provide to us, and ensuring your understanding of how we collect, use, disclose and maintain your Personal Information is important to us. We maintain reasonable physical, electronic and procedural safeguards to protect your information and while no data transmission over the Internet is completely secure, we have used and will continue to use commercially reasonable efforts to ensure the protection of your Personal Information.
Residents of the State of California, under the California Civil Code, have the right to request from companies conducting business in California, a list of all third parties to which the company has disclosed Personal Information during the preceding year for direct marketing purposes. Alternatively, the law provides that if the company has a privacy policy that gives either an Opt-out or Opt-in choice for use of your Personal Information by third parties (such as advertisers or affiliated companies) for marketing purposes, the company may instead provide you with information on how to exercise your disclosure choice options.
MTVN's Service qualifies for the alternative option: it has a comprehensive privacy policy and provides you with details on how you may either Opt-out of or Opt-in to the use of your Personal Information by third parties for direct marketing purposes. Therefore, we are not required to maintain or disclose a list of the third parties that received your Personal Information for marketing purposes during the preceding year.

The Website, the Software and the Service are designed and targeted to U.S. audiences and governed by and operated in accordance with the laws, regulations, and treaties of the U.S. By your use of the Website, the Service and/or the Software, your registration as a Registered User or your establishment of an Account or Payment Account in the Service and/or your attempt to do any of these things, you certify that you are at least 13 years of age and a resident of the Territory and if you are a Minor, you have obtained consent from your parent or legal guardian as required (Please go to the section of the Terms of Use Agreement entitled Age Eligibility Requirements and the Parent/Legal Guardian Consent for Minors section of the Registered User Agreement for the requirements applicable to Minors). We make no representation that the Website, the Software or the Service is or are operated in accordance or governed by the laws of other nations or jurisdictions. If you are located in the European Union or elsewhere outside of the U.S. and you use the Website, Service or Software contrary to the Agreement which states that only Territory residents are eligible for certain activities, you do so at your own risk and initiative, and are responsible for compliance with any applicable local and national laws.
Please be aware that any Personal Information we obtain from you, you transfer or provide to us will be transferred to the U.S and subject to U.S. law. By using the Service, the Website and/or the Software, registering as a Registered User, setting up an Account and/or Payment Account, participating in any Website or URGE activities and/or providing us with any of your Personal Information, you consent to the transfer of your Personal Information to and from the U.S. and waive any claims that may arise under your own or any other local or national laws. All users of the Website, URGE and/or the Software are required to provide true, current, complete and accurate Personal Information when prompted and we have the right to refuse or revoke your right to use the Website, URGE, any Software, your registration as an URGE Registered User, your Account and Payment Account and/or reject and delete any entry, if we believe in good faith that information you provide to us is or may be false, fraudulent, or inconsistent with this Privacy Policy or in violation of the Agreement. Your continued use of URGE, the Website or the Software indicates your acceptance of this Privacy Policy and of the collection, use, disclosure, maintenance, management and storage of your Personal Information as described below. We may from time to time, transfer or merge any Personal Information collected off-line to our online databases or store off-line information in an electronic format. We may also combine Personal Information we collect online with information available from other sources, including information received from our Advertisers (as defined in our Terms of Use Agreement). This Privacy Policy remains applicable to your Personal Information for as long as such Personal Information is in our possession, even if you terminate or discontinue your use of URGE, our Software and/or the Website and you acknowledge and agree you will be bound by its terms.
Collection and Use of Personal Information: When we use the term "Personal Information" we mean information such as your first/middle initial or name and last name, street address, town or city, state, zip code, telephone number, instant-messenger nickname, blog or other personal website URL, date of birth, email address and any other information that would allow someone to identify you or contact you. Personal Information also includes information about your personal preferences, survey responses and your transactions or relationship with us, if you have been a customer or you have provided this type of information to any of the MTVN family of companies. For example, if you order any Products, in addition to your name and contact information, we will also collect and maintain your billing address, shipping address, Product selections, your credit card or other payment instrument information, your order number, and information about your computer's internet address and web site which may have referred or directed you to the Website (e.g., the referring URL). Your credit card, debit card account number, or other payment account data is classified as "Sensitive Personal Information" and is collected via a secure transmission.
We collect Personal Information about you when you use the Software, the Website, use URGE, as a user or Registered User (including during a free Trial Period), and whether or not you set up an Account or Payment Account, register for a Paid Subscription Plan, enroll or sign up for particular activities, services, features or functions, participate in Promotions, order or purchase Products or other goods or services or simply in the course of other exchanges of information, transactions and activities in connection with the Service. We may use your Personal Information to tailor your experience on URGE, review your content libraries and local files to better understand your preferences and make recommendations, to display Content, Promotions, information or offers we think may be of interest to you and/or to customize your URGE and/or Website experience according to your preferences.
It is your responsibility to give us current, complete, truthful, and accurate information and to keep the Personal Information that you provide us up to date. We cannot and shall not be responsible for any problems or liability that may arise if you do not give us accurate, truthful or complete information or you fail to update the information you give us.
You are solely responsible for maintaining the confidentiality of your User ID and for any charges, costs, expenses, damages, liabilities and losses we incur or may suffer as a result of your failure to do so. You, and not us, are solely responsible and liable for your activity, behavior, use and conduct on or in connection with URGE and the Website and for any use of URGE, the Website, Software and any other activity or conduct in connection with URGE, and by any others who use your User ID, your Account or Payment Account, your registration or otherwise until you notify us that your User ID may have been compromised, misappropriated or improperly taken or used by another party. Bear in mind that when you submit information to us, it does not guarantee that we will permit you to participate in or use any or all of the activities, services, features or functions of the Website, URGE or the Software.
- Collection of Personal Information for Free Trial Subscriptions: Registered Users are required to establish and maintain a User ID and Registered Users that wish to have a Trial Period, use certain features and functions of URGE, subscribe to and purchase Paid Subscription Plans, music or other Content on an a la carte basis, Products, goods or services or Gift Certificates must set up an Account, or if applicable, a Payment Account which requires you, as a Registered User to submit additional Personal Information, such as payment account information, as described in our Registered User Agreement . As a user and/or as a Registered User of URGE, the Software or the Website, you acknowledge, understand and hereby agree you are giving us your consent to track activities and your use of the Website, Service, Software, Promotions, purchases of Products, Gift Certificates and any activities, services, functions and features in connection with these. You are also confirming your agreement to comply with all the terms and conditions in the Agreement, of which this Privacy Policy forms a part.
Collection of Personal Information for Registered Users. Registered Users are required to submit Registered User Information and maintain a User ID. Registered Users that set up an Account and/or Payment Account are required to provide additional Registered User Information in order to take advantage of the services, feature and functions that apply and are available in doing so. Certain Personal Information, such as date of birth, cannot be changed, unless you provide sufficient verification to the Privacy Administrator at privacy@urge.com that the date of birth entry was mistakenly entered. To help avoid such mistakes, we have installed a double entry process for the date of birth, in which the user is required to enter his or her date of birth twice during the registration process. As a Registered User, from time to time, we may provide you with certain opportunities to opt-in to subscribe to email newsletters and other periodic communications and information we may send you. If you opt-in, you acknowledge, understand and hereby agree you are giving us your consent to track your activities, your use of the Website, Service, Software, Promotions and all activities, functions and features in connection with your request to opt-in. You are also confirming your agreement to comply with all the terms and conditions in the Agreement, of which this Privacy Policy forms a part.
Because the Software includes security components that permit digital information, including, without limitation, Content available to you in connection with the Service and the Website to be protected and allow use only as permitted by us and/or Content providers, there are some special rules and procedures that apply. For example, as a Registered User we shall (and you agree we are permitted) to transmit and arrange for automatic installation of any and all updates, modifications, and/or even full re-installations of the Software to address security, digital rights management, interoperability, and/or performance issues. The Software also includes automated features that collect information that allows the Software to automatically identify your computer and your system, the version of the Software in use and to manage some or all of the digital rights associated with Content. These features may be remotely activated in order to update security components used by the Software, including, without limitation, portions of the Windows Media Player associated with your use of URGE. These updates, modifications, re-installations and other modifications to the Software can occur periodically or when necessary and without any notice to you. If we have collected any non-personally identifiable information while you were a user of the Website, the Service or the Software but before you became a Registered User, once you register and become a Registered User we may transfer the information previously collected with your Account.
Collection of Personal Information In Connection with Promotions. Neither registration as a Registered User, nor establishment of an Account or Payment Account is or are required to use the Software or the Website or some portions of the Service and may not always be required to enter or participate in certain Promotions available on the Website or made available by or through URGE (for example, sponsored contests or sweepstakes). Such Promotions may have a separate registration or entry process and may require your submission of Personal Information such as your first and last name, street address, city, state and zip code, email address, telephone number and date of birth. The entry page and/or Rules will provide the specific requirements for the Promotion involved. You may also have the opportunity to opt-in to special Promotions or offers from our Advertisers in connection with many of these Promotions. When you participate in any Promotion, you are also confirming your agreement to comply with this Privacy Policy and all the terms and conditions in the Agreement which may apply to you and such participation.
`Use of Personal Information In Connection with Promotions and Offers - Opt Out Procedures. We may contact Registered Users by email or text messaging to promote URGE, the Website, Promotions and Gift Certificates or to send offers for the purchase of Products that we believe may be of interest. Registered Users may "opt out" of receiving marketing and promotional emails or text messages from us by following the "Account Summary" link on the Website home page at http://www.urge.com/termsofuse.jhtml#registeredUser). and selecting "Preferences" and then "Edit Preferences" or by using the opt-out mechanism that is contained in the email or text message we send you. Basic Registered Users (as defined and described in the Registered User Agreement ) during a Trial Period must use the email opt-out method. However, we may continue to contact you via email for administrative or informational purposes, including follow-up messages regarding the administration of your account, your payment account, Paid Subscription Plans, Promotions you have entered or participated in, Products you have ordered or other transactions you have undertaken with or in connection with URGE.
In the event that we unknowingly send an email or text message to a child (a person under the age of 13 years) who has become a Registered User, a user or otherwise may have registered with URGE, any Promotion or otherwise in violation of this Agreement, the child or the child's parent or legal guardian always have the right to unsubscribe (opt-out) from receiving future emails or text messages using the "unsubscribe" (opt-out) mechanism contained in the email or message, or to request termination of the child's registration, Account, Payment Account and/or status as a Registered User with URGE and/or any Promotion. The same is true for the parent or legal guardian of a Minor. Please see the Section of this Privacy Policy below entitled Review, Update, or Delete Your Personal Information for details.
- Sharing of Aggregate Information with Third Parties. Some of the aggregate data we collect in connection with our Website, URGE and/or Software may be shared with Advertisers and other business partners of MTVN and MTVN Entities, but we do not give any Personal Information to them as part of the relationship except as described in this Privacy Policy. Use of their tracking technology is subject to their own privacy policies. Wireless Marketing Services and Promotional Opportunities: URGE may also provide its valued Registered Users with the opportunity to register for special promotions, services, music, video and/or other news, programming and information delivered via text messaging and wireless devices (e.g., mobile phones). Such services and promotional opportunities will be provided by MTVN for URGE. Registered Users are required to provide their consent to receive such information from MTVN, either by registering on the Website or via their wireless device. Users may be required to re-enter or provide additional Personal Information such as a Registered User's wireless telephone number or a wireless email address, but only if specifically requested, and the carrier's name. Optional information may be requested for specific Promotions, such as a Registered User's preferences regarding goods, services, choices of music or artists, or other similar survey information. Depending on the Promotion, we may also collect (and require Registered Users to re-enter) an email address or other information and, depending on the information collected, a Registered User may also be required to confirm his or her agreement to be bound by and comply with this Agreement and any additional terms and conditions applicable to the Promotion, the use of the features, functions or services involved or to take advantage of such promotional opportunities. We caution that most wireless transmissions are not secure and there is a greater risk of an unknown third party's interception of messages or a Registered User's Personal Information when using a wireless communications device.
Registered Users that also register for MTVN's wireless marketing services acknowledge, understand and agree they shall be charged by their wireless carrier for all messages sent to the Registered User in connection with these wireless marketing services. Standard messaging rates will apply unless noted otherwise. Under no circumstances will MTVN or any of the MTVN Entities or any of our Advertisers be responsible for any wireless email or text messaging charges incurred by a Registered User or by any person that has access to a Registered User's wireless device, telephone number or email address.
- Registration. There are two registration methods provided for MTVN's wireless marketing services. Standard rate promotions will be subject to either the "single opt-in" or the "double-opt-in" (Website/SMS) method, at the discretion of MTVN depending on the type of promotion. Premium rate services will require the "double opt-in" (Website/SMS or SMS/SMS) method.
- Single Opt-in Method: In response to a print, radio, television, Internet, or other promotional message, Registered Users will be directed to send a specific word or code via a text message to a designated telephone number to register for the service promoted. The Registered User's voluntary submission of the designated word or code to MTVN will mean that the Registered User has freely and affirmatively granted permission to MTVN to send text messages to him or her. MTVN will thank the Registered User for his or her registration in the wireless service by sending a "Thank you" message. The Registered User may terminate the wireless service at any time by using the unsubscribe command in any text message from MTVN or by sending a text message to MTVN that says "STOP", "END", "CANCEL", "REMOVE", "UNSUBSCRIBE" or "QUIT".
- Double Opt-in (Website/SMS) Method: In response to a print, radio, television, Internet, or other promotional message, Registered Users will be directed to the Website to start the registration process for the wireless service. The Registered User must affirmatively consent to MTVN's sending of wireless messages to his or her designated wireless device by submitting a telephone number (or wireless email address, only if requested by MTVN) and by clicking the consent statement on the designated registration page for the wireless service. The Registered User must also confirm his or her acceptance of the Terms of Use Agreement,the Copyright Compliance Policy , Registered User Agreement , EULA and this Privacy Policy before the online registration process for the wireless service is completed. MTVN will then send a "Confirmation" message to the Registered User's designated wireless device and will request that the Registered User confirm that he or she has agreed to receive messages from MTVN to that particular telephone number (or wireless domain name when appropriate). The Registered User must respond to the "Confirmation" message with a text message that states "YES" or "Y" that will indicate the Registered User's acceptance of MTVN's wireless marketing service. Until the Registered User responds to the "Confirmation" message, the Registered User is not registered for the specific wireless marketing service subject to the promotion. A Registered User may respond to the "Confirmation" message at any time; provided that MTVN may choose to terminate offering any wireless marketing service at any time and the Registered User's response to the "Confirmation" is only valid if the response is received while MTVN continues to offer the specific wireless marketing service.
- Double Opt-in (SMS/SMS) Method: In response to a print, radio, television, Internet, or other promotional message, Registered Users will be directed to send a specific word or code via a text message to a designated telephone number to register for the wireless service promoted. MTVN will then send a "Confirmation" message to the Registered User's designated wireless device and will request that the Registered User confirm that he or she has agreed to receive messages from MTVN to that particular telephone number (or wireless domain name when appropriate). The Registered User must respond to the "Confirmation" message with a text message that states "YES" or "Y" that will indicate the Registered User's acceptance of MTVN's wireless marketing service. Until the Registered User responds to the "Confirmation" message, the Registered User is not registered for the specific wireless marketing service subject to the promotion. A Registered User may respond to the "Confirmation" message at any time; provided that MTVN may choose to terminate offering any wireless marketing service at any time and the Registered User's response to the "Confirmation" is only valid if the response is received while MTVN continues to offer the specific wireless marketing service.
- Termination of Wireless Services by User. Regardless of which one of the above opt-in methods was used to register, a Registered User may revoke his or her consent to receive messages from MTVN and cancel one or more wireless services via his or her wireless device at any time by using the unsubscribe mechanism provided by MTVN at the time the message is sent, or by sending a text message that says "STOP", "END", "CANCEL", "REMOVE", "UNSUBSCRIBE" or "QUIT". MTVN will terminate the Registered User's registration for the most recent wireless service sent to the Registered User. Any of these words followed by the word "ALL" in the Registered User's termination request will cancel all of the Registered User's registered wireless services with MTVN. If the Registered User unsubscribes from one or all of MTVN wireless services via his or her wireless device, the wireless services will be terminated immediately and will cancel the Registered User's previous opt-in.
- Termination of Wireless Services by MTVN. The Registered User understands, acknowledges and agrees that MTVN may, at its sole discretion and without liability to any Registered User, terminate its offer of any specific wireless marketing service or all wireless marketing services at any time without advance notice. MTVN may provide notice of termination or changes in such services on the Website.
- Use of Information. MTVN will not use a wireless telephone number, wireless or conventional Internet email address, or other information submitted for its wireless marketing services for any other purpose but to provide the wireless marketing service requested, unless we provide advance notice to the Registered User of any other use. We will not share Personal Information obtained solely in connection with the wireless marketing services you elect to receive, with Advertisers or other third party marketers unless you opt-in to such use and disclosure to them. We will share this information with the operational service providers that assist us in delivering these wireless marketing services to you and with MTVN Entities.
Cookies and Similar Technology: We use 'cookie' technology to collect data regarding your visits to URGE, the Website and your use of the Software. This data is stored in aggregate form and is not used to identify any particular Registered User, user or individual. We use cookies and similar tracking technologies in a variety of ways, including:
- Saving your User ID or other information so you don't have to re-enter it each time you visit URGE, the Website and/or use the Software.
- Keeping count of your return visits to URGE, the Website or our Advertisers' or partners' sites and your use of the Software;
- Accumulating and reporting aggregate, statistical information in connection with URGE, the Website and the Software; and
- Determining which services, features, functions and activities users and Registered Users like best.
Although we may track the numbers of visitors to inform us on how best to update and enhance URGE and/or the Website, Personal Information is not extracted in this process. We use tracking information on an aggregated basis to help us operate URGE and the Website, enhance and improve URGE and the Website and display advertising and marketing information. You can choose to have your computer warn you each time a cookie or image tag is being sent, or you can choose to turn off all such mechanisms. This is done through your browser. If you turn cookies off, you may not have access to many features and functions of the Service, the Website and/or the Software that make your Internet experience more efficient and enjoyable – like those mentioned above – and some of our other services will not function properly.
URGE and/or the Website may contain advertisements, references and links to other services, web sites and organizations. We may also use third parties to display or serve advertising on URGE, the Website and communications to you. Often these third party Advertisers employ cookie and web bug technologies to measure advertising effectiveness. You should be aware that different rules might apply to the collection, maintenance, use and disclosure of your information by third parties in connection with their advertisements, promotions and other web sites you encounter on the Internet. The use of such technology by these third parties is within their control and not ours. Even if we have a relationship with a third party, we do not control their web sites, their technology or their policies and practices regarding your information. This Privacy Policy does not cover any use of Personal Information or Sensitive Personal Information that a third party, an Advertiser or ad server may collect from you. We encourage you to investigate and ask questions directly of them in this regard.
Postings: We respect the privacy of the contents of users' email and other communications and correspondence (collectively, "Postings"). However, we reserve the right to monitor, edit and disclose your use of URGE, the Website, the Software and/or any information pertaining to a Posting or its contents to a third party if we believe such action is required by law or is necessary to protect and defend our rights, to enforce this Privacy Policy or the Agreement or to protect the interests of our users, Registered Users, MTVN Entities, Advertisers, suppliers, operational service providers and others.
Disclosure to Third Parties: We do not sell, rent, lease or disclose your Personal Information to unaffiliated entities or entities that are not MTVN Entities or our Advertisers, except in the limited circumstances listed in this Privacy Policy. When we plan to disclose your Personal Information to Advertisers, we ask for your consent ("Opt in") to do so, in which case their use of your information is subject to the Advertisers' own privacy policies. URGE and/or the Website may also offer co-branded services, features and functions, which are activities, events and promotions (for example, a contest) that we put together with another company ("Co-Branded Partner"). We will share your Personal Information with our Co-Branded Partner and your voluntary use or participation in a co-branded activity, service, feature or function means you have given your affirmative consent to both MTVN and our Co-Branded Partner to collect, maintain and use your Personal Information. If you wish to opt-out of a Co-Branded Partner's future use of your Personal Information, you will need to contact the Co-Branded Partner directly.
We also have the right to disclose your Personal Information to third parties for the purpose of administering and maintaining URGE's services, features, functions and operations. These third parties specialists that provide support to URGE, our Website and the Software are called "operational service providers". We use operational service providers to efficiently provide the full range of Content, subscription services, Promotions, download, streaming and other features, functions and services that we bring you and we request that our operational service providers also protect your privacy and not disclose your Personal Information or Sensitive Personal Information to third party marketers that are not associated with URGE, the Website or the Software. Additionally, these operational service providers are not permitted to use your Personal Information or Sensitive Personal Information for their own marketing or promotional purposes.
We will make your Personal Information or Sensitive Personal Information available to non-affiliated third parties in the following limited circumstances:
Security and Protection of Personal Information: We maintain reasonable standards of security and confidentiality. However, for most Internet sites, it is possible that third parties may unlawfully intercept or access transmissions or private communications over an unsecured transmission. We conduct financial transactions via secured transmissions but may not always secure other parts of URGE. We also limit access to the Website by our own employees to those individuals who are authorized for the proper handling of such information and any employee found violating our standards of security and confidentiality will be subject to our disciplinary processes. We request that our operational service providers follow the same policy.
Review, Update or Delete Your Personal Information: Generally, you may review, update or delete your Personal Information or Sensitive Personal Information collected by or through the Website. You may also correct factual inaccuracies. However, Personal Information that is necessary to check eligibility, such as date of birth or age, cannot be deleted but may be modified with sufficient verification of the correct information. Although you may update your email address, deletion (or attempted deletion) of certain Personal Information, such as email address or date of birth, may result in suspension of any Account or Payment Account you have set up, your registration as a Registered User and/or your participation in the Service (including, without limitation, any Trial Period, Paid Subscription Plan, Promotions, use of Gift Certificates). If you are a Registered User and have established an Account, you may review, update or delete your Personal Information, by going to the "Account Summary" section in the Service and follow the instructions that will allow you to edit, change, update and/or delete your Personal Information, except as otherwise noted in our Agreement with you.
If you do not understand or are not sure what Personal Information may be collected for Promotions such as contests and sweepstakes, you will need to contact the Website's Privacy Administrator via email with a request at privacy@urge.com and be prepared to provide verification of your identity. Personal Information collected for Promotions such as a contest or sweepstakes entry is subject to corporate and regulatory recordkeeping requirements and will not be deleted upon the user's request unless the entrant is a child under the age "of 13 years old.
Children under the age of 13 that register as Registered Users or otherwise with URGE or the Website or use the Software, are in violation of this Agreement. In the event that a child has become a Registered User or otherwise registered with URGE, set up an Account or Payment Account, enrolled in any Promotion or other activity or is using URGE, the Website and/or the Software in violation of the Agreement, the parent or legal guardian of such child may terminate their child's Account or Payment Account or modify any selections the child may have made, by using their child's User ID to gain direct access to the child's Account information by going to the "Account Summary" section in the Service and following the instructions that allow Account information to be edited, changed, updated and/or deleted. Alternatively, a parent or legal guardian may contact us at privacy@urge.com and provide verifiable identification that they are the parent or legal guardian of the ineligible child and request that such child's Account be changed or terminated. We will not allow direct access to a Registered User's Personal Information by any person without the Registered User's User ID. If a parent or legal guardian does not have his or her child's User ID, the parent or legal guardian will be required to send an email to the privacy@urge.com that includes the parent's name, address, telephone and email address, in addition to the child's name and email address as registered with URGE, as a Registered User or otherwise, plus the child's date of birth. MTVN will send a confirming email to the parent via the email address provided to verify that the parent wishes to terminate his or her child's registration. The parent or legal guardian must then confirm by sending a reply email to the return address designated by us. MTVN will then terminate the child's Account and registration as requested by the parent or legal guardian but will notify the child of the termination request via email and will identify the name, address and email address of the person making the request.
We reserve the right to suspend, deactivate, terminate or deny registration, status as a Registered User, the setting up, establishment and/or maintenance of an Account or Payment Account, access to URGE or the Website, Trial Periods, Paid Subscription Plans, the use of Software and/or any Promotions, purchase and redemption of Gift Certificates, purchase of Products, use of any services, activities, features or functions to any user or Registered User if we believe there is a question about the identity of the person trying to access any Registered User information or use your User ID. If the burden or expense of providing access to your Personal Information is disproportionate to the risks to your privacy, or if the legitimate rights of others would be violated, we may decide not to provide you access to such information. In such cases, we will provide you with an explanation of why access cannot be provided and a contact person for further inquiries.
